Baribeau, M.D., P.A., individually and doing business as the Cataract and Laser Institute, and the Center for Laser Enhancement (collectively referred to as Baribeau) filed a motion for rehearing of our opinion issued November 27, 2002. See Baribeau v. Gustafson, 2002 WL 31662059 (Tex. App.-San Antonio Nov. 27, 2002, no pet. h.). Baribeau's motion for rehearing is denied. This court's prior opinion and judgment are withdrawn, and this opinion and judgment are substituted in their place.
